Preparing to Enforce a Foreign Judgment or Arbitral Award in Syria

Cross-border enforcement should be assessed before proceedings abroad are complete whenever Syrian parties or assets may matter.

Identify the instrument

A foreign court judgment and an arbitral award do not follow identical routes. Counsel should first classify the instrument, confirm the issuing jurisdiction and identify any treaty or national-law framework.

Review jurisdiction and due process

The file should show how jurisdiction was established, how each party was notified and whether a genuine opportunity to present the case existed. Defects in service or procedure can become central at the enforcement stage.

Prove finality and assemble originals

The complete decision, reasons, arbitration agreement where relevant, proof of finality or enforceability, certified copies, legalisation and Arabic translations should be mapped before filing. Requirements must be confirmed for the particular country and instrument.

Assess objections and assets

Public-policy issues, inconsistent decisions, prior payment and other objections may affect recognition. Separately, an asset review is needed because recognition alone does not guarantee commercial recovery.
